These Terms and Conditions (“Terms”) govern access to and use of the Marina Utility Services mobile application, website, QR asset tracking systems, and related services (collectively, the “Platform”) operated by Marina Utility Services LLC (“Company,” “we,” “our,” or “us”). By creating an account or using the Platform, users agree to these Terms.
1. Platform Services
The Platform provides marina utility asset management, QR code tracking, service documentation, maintenance scheduling, inspection records, technician workflows, owner reporting features, and related operational tools.
2. User Accounts
Users are responsible for maintaining account credentials and all activity occurring under their account.
3. Acceptable Use
Users agree not to misuse the Platform, interfere with operations, attempt unauthorized access, upload malicious content, or violate applicable laws.
4. QR Asset Data and Service Records
Users understand inspection records, maintenance logs, photographs, service history, and QR asset tracking information may be stored within the Platform.
5. Payments and Subscriptions
Subscription fees, service fees, and billing terms, if applicable, will be disclosed within the Platform. Fees may change upon notice.
6. Intellectual Property
All Platform software, branding, content, workflows, graphics, and proprietary systems remain property of Marina Utility Services LLC.
7. Availability
We strive for reliable operation but do not guarantee uninterrupted availability or error-free functionality.
8. Disclaimer of Warranties
The Platform is provided ‘AS IS’ and ‘AS AVAILABLE’ without warranties of any kind, express or implied.
9. Limitation of Liability
Marina Utility Services LLC shall not be liable for indirect, incidental, special, consequential, or business interruption damages arising from Platform use.
10. Indemnification
Users agree to defend and hold harmless Marina Utility Services LLC from claims arising from misuse or violation of these Terms.
11. Termination
We may suspend or terminate accounts for violations of these Terms.
12. Governing Law
These Terms shall be governed by Florida law without regard to conflict of law principles.
13. Changes to Terms
We may update these Terms periodically. Continued use constitutes acceptance of revisions.
